Ironbark Training – Terms and Conditions

These Terms and Conditions govern the provision of training, assessment, and related services by Ironbark Training. By engaging our services, you acknowledge and agrees to be bound by these Terms.

1. Scope of Services

1.1 Ironbark Training provides nationally recognised and non-accredited training services across the safety, compliance, high-risk, and industrial sectors, including but not limited to:

  • High-Risk Work Licence training and assessment
  • Workplace Health and Safety (WHS) programs
  • Industry-specific competency-based training – Statements of Attainment/tickets
  • Verification of Competency (VOC) assessments
  • Full qualifications
  • Refresher training and compliance updates
  • On-site, mobile, and remote training delivery
  • On-site mentoring
  • Non accredited training
  • Access to Ironbark Training’s Employment Management System and Learning Management System

1.2 All training and assessment activities will be delivered by qualified trainers and assessors who meet relevant regulatory and industry competency requirements.

1.3 Full access to Ironbark Training’s after-hours service

2. Bookings, Scheduling, and Delivery

2.1 Bookings must be submitted via email, online request, or phone. A booking is not confirmed until confirmation has been issued by Ironbark.

2.2 While Ironbark endeavours to accommodate urgent and short-notice training requests, delivery is subject to trainer availability, travel logistics, and compliance requirements. These courses may incur costings as per our rates sheet.

2.3 The Client must ensure that the training venue when requested on site meets all WHS obligations, including but not limited to adequate lighting, space, emergency procedures, and access to relevant plant, equipment, or materials required for training. This is subject to inspection prior to delivery by qualified trainer/assessor on behalf of Ironbark Training.

3. Travel, Accommodation, and On-Site Requirements

3.1 Ironbark Training delivers services Australia-wide. Travel charges may apply and may include travel time, mileage, accommodation, meals, and other related expenses.

3.2 Where training occurs at the Client’s premises, the Client is responsible for ensuring:

  • A safe and compliant work environment
  • Functional and compliant machinery, tools, or plant (where applicable)
  • Availability of required PPE for all participants
  • That plant and equipment meet regulatory and manufacturer standards
  • Ironbark can organise equipment if required – cost +10%

4. Fees, Payments, and Invoicing

4.1 All pricing will be outlined in a formal quotation or service agreement.

4.2 Invoices are payable prior to delivery of training unless otherwise agreed in writing.

4.3 Ironbark reserves the right to withhold issuance of certificates, Statements of Attainment, or assessment outcomes until all outstanding fees have been paid.

4.4 Late payments may incur interest charges or administrative fees as permitted by law.

5. Cancellations, Rescheduling, and Non-Attendance

5.1 All cancellation or rescheduling requests must be provided in writing.

5.2 The following cancellation fees apply:

  • More than 48 hours’ notice (business days): No charge.
  • Less than 48 hours’ notice (business days): 50% of the total service fee.
  • Less than 24 hours or same-day cancellation or failure to attend (business days): 100% of the total service fee.

5.3 Substitution of participants may be permitted provided all eligibility and identification requirements are met.

6. Participant Requirements and Conduct

6.1 Participants must:

  • Provide valid identification (e.g., driver licence, USI verification)
  • Meet all prerequisites relevant to the course
  • Wear appropriate PPE
  • Present in a fit state to undertake training

6.2 Ironbark reserves the right to refuse participation or remove any participant who:

  • Is under the influence of drugs or alcohol – may be subject to testing on request
  • Behaves in a disruptive or unsafe manner
  • Presents a risk to themselves or others

7. Certification, Assessment Outcomes, Records & ASQA Compliance

7.1 Certification and Statements of Attainment will be issued only upon:

  • Successful completion of all assessment requirements in accordance with the Standards for Registered Training Organisations (RTOs) 2015.
  • Verification of participant identification and USI requirements per the Student Identifiers Act 2014.
  • Finalisation of all outstanding invoices.

7.2 Ironbark Training complies with the Standards for RTOs 2015, including but not limited to:

  • Standard 1: Ensuring training and assessment strategies and practices are responsive to industry and learner needs and align with Training Package requirements.
  • Standard 2: Engaging with industry stakeholders to ensure relevance and currency of training and assessment.
  • Standard 3: Issuing AQF certification documentation in accordance with regulatory timeframes and record-keeping requirements.
  • Standard 4: Providing accurate and factual marketing and advertising materials.
  • Standard 5: Ensuring learners are fully informed prior to enrolment, including rights, obligations, support services, and training pathways.
  • Standard 6: Implementing a fair and accessible complaints and appeals process.
  • Standard 7: Managing governance, compliance, and risk in accordance with regulatory obligations.

7.3 Ironbark Training maintains training and assessment records in accordance with ASQA requirements and relevant legislation.

7.4 Ironbark Training will not issue certification where assessment has not been completed in full, or where competency cannot be demonstrated.

8. Client Responsibilities

The Client must:

  • Provide accurate booking details, participant information, and site requirements
  • Ensure all participants attend on time and are ready for training
  • Ensure compliance with WHS legislation at the training site
  • Notify Ironbark of any hazards, incidents, or changes affecting training delivery

9. Liability, Indemnity, and Force Majeure

9.1 Ironbark accepts no liability for delays, disruptions, or failure to deliver services where caused by circumstances beyond its reasonable control, including but not limited to weather, natural disasters, industrial action, or equipment failure.

9.2 The Client indemnifies Ironbark against any claims, losses, or damages arising from:

  • Unsafe or non-compliant training environments provided by the Client
  • Use of the Client’s machinery or equipment during training
  • Participant misconduct or non-compliance

10. Privacy and Data Handling

10.1 Personal information collected by Ironbark is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

10.2 Information is used solely for training, assessment, certification, reporting, and compliance.

11. Governing Law

These Terms are governed by the laws of the State of New South Wales, and the parties submit to the jurisdiction of the courts of that State.

12. Acceptance of Terms

By booking or participating in training delivered by Ironbark Training, the Client confirms that they have read, understood, and agreed to be bound by these Terms and Conditions.
